What is Proposition 65? The California Safe Drinking Water and Toxic Enforcement Act of 1986, commonly referred to as “Proposition 65,” is a California voter initiative originally designed to protect citizens and sources of drinking water from harmful chemicals. The State is required to maintain and publish a list of substances, a wide range of naturally occurring and synthetic substances, that have been identified by the state to cause cancer, birth defects or other forms of reproductive harm. Currently, over eight hundred substances are on the list. Substances can be added to or removed from the list by various mechanisms, such as declaration by an authoritative body or by scientific testing.

Many of the substances on the list are naturally occurring in the environment or are now present in the environment through increased industrial activity. Natural products—including herbs, vitamins, minerals and other supplements, as well as many natural foods and cosmetics— are produced using ingredients and materials from the natural environment. Because of this, it is possible that some of the substances on the list may from time to time be present in natural products. In addition, some of the ingredients found in natural products—such as progesterone found in natural progesterone products—are in and of themselves identified as substances on the Prop 65 list. Progesterone is one of these substances. So all topical progesterone creams will bear this same warning label, in the state of California.

Why is a Proposition 65 label required?

The Prop 65 warning is required only in the state of California. Proposition 65 requires entities doing business in California to provide warnings to consumers about exposures to substances that have been identified by the state to cause cancer, birth defects or reproductive harm. The following warning statements are required by California law and apply to some of the products available from us. Bezwecken products that contain Progesterone, Estriol or Goldenseal Root Powder will have a label similar to these:

Why am I seeing this label if I don’t live in California?

Did you purchase our product from amazon.com? If so, amazon.com is requiring this label on all products containing a Prop 65 substance that are to be shipped Fulfilled By Amazon (FBA). amazon.com cannot separate the warning labels to shipments going only to CA so unfortunately all states will be receiving the Prop 65 warning label on the product.

Here at Bezwecken, we hand apply this label only to products with a Prop 65 substance that are being shipped to the state of California.
